MatchaMocha Terms of Service

1. Acceptance of Terms
Welcome to MatchaMocha ("we," "us," "our," or "the Service"). MatchaMocha is operated by MatchaMocha, based in Georgia, United States.
By creating an account, accessing, or using the MatchaMocha platform (including our website, mobile application, and related services), you ("you," "your," or "User") agree to be bound by these Terms of Service ("Terms" or "Agreement") and our Privacy Policy and Community Guidelines.
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.
Continued use of the Service constitutes ongoing consent to these Terms, including any modifications we may make. We reserve the right to modify these Terms at any time (see Section 16 for details).
2. Eligibility
You must meet ALL of the following requirements to use MatchaMocha:
• You are at least 18 years of age
• You have the legal capacity to enter into this binding agreement
• You are not prohibited by law from using the Service
• You have not been previously banned or suspended from MatchaMocha
• You have never been convicted of or pled no contest to a felony, or any crime involving violence, sexual misconduct, harassment, stalking, fraud, or any offense involving a minor
• You comply with all applicable local, state, national, and international laws
We reserve the right to request verification of age and identity at any time, including through government-issued ID or other documentation. Failure to provide requested verification may result in account suspension or termination.
By using MatchaMocha, you represent and warrant that you meet all eligibility requirements.
3. Nature of Service and User Responsibility
3.1 In-Person Dating Service
MatchaMocha is an automatic, in-person dating service. Unlike traditional dating apps where users browse profiles and decide whether to meet:
• MatchaMocha automatically matches you with other users based on compatibility preferences
• You are expected to meet your matches in person at a designated public venue
• The app arranges the date details (time, location, venue) based on mutual availability
• Matches are automatic - there is no swiping, liking, or manual selection process
By using this Service, you acknowledge and agree to participate in in-person dates with users you are matched with.
3.2 Unique Features of MatchaMocha
MatchaMocha operates differently from other dating apps. Key features include:
Automatic Matching System: • Users enter a matching queue and are paired with compatible users using a First-In-First-Out (FIFO) algorithm
• Compatibility is determined by mutual preferences (gender, age range, ethnicity, date type, location proximity, time availability)
• You do not choose your matches - the algorithm selects them for you based on your stated preferences
Credit System: • Matcha Credits (🍵): Limited credits that renew weekly (every Monday at 00:01 AM)
• Mocha Credits (☕): Unlimited credits available for purchase
• Credits are consumed when you successfully match with another user
• Free users receive 1 Matcha credit per week; additional credits can be purchased
In-Person Meeting Requirements: • All matches result in scheduled in-person dates at public venues
• The app suggests nearby venues (cafes, parks, restaurants, bars, movie theaters) based on your selected date type preferences
• Meeting times are coordinated based on both users' availability
Penalty System: • Users who cancel scheduled dates may receive a 24-hour matching cooldown
• Repeated no-shows or policy violations may result in longer suspensions or permanent bans
Reporting and Safety: • Users can report policy violations or concerning behavior
• Automatic warnings are issued for first offenses; second offenses result in permanent bans
• All reports are reviewed by our team
3.3 YOUR SOLE RESPONSIBILITY
YOU ARE SOLELY AND ENTIRELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS, BOTH ONLINE AND OFFLINE.
This includes but is not limited to: • Your safety and well-being during in-person meetings
• Your conduct and behavior toward other users
• Your decisions about whether to attend a scheduled date
• Your choice of transportation to and from meeting locations
• Your evaluation of other users' trustworthiness, character, and intentions
• Any information you share with other users (phone number, personal details, social media)
• Any consequences arising from your interactions with other users
4. DISCLAIMERS REGARDING PHYSICAL SAFETY AND IN-PERSON MEETINGS
4.1 NO BACKGROUND CHECKS OR VERIFICATION
MATCHAMOCHA DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS, IDENTITY VERIFICATION CHECKS, SEX OFFENDER REGISTRY SEARCHES, OR OTHERWISE INQUIRE INTO THE BACKGROUND OF ITS USERS.
WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING: • The identity, character, intentions, legitimacy, or veracity of any user
• The conduct, behavior, or criminal history of any user
• The health, physical condition, mental state, or capacity of any user
• The accuracy or truthfulness of information provided by users in their profiles
• The safety of any venue, location, or meeting arranged through the Service
• The compatibility, suitability, or appropriateness of any match
Phone Verification: While we require users to verify their phone numbers via SMS, this does not constitute identity verification, background screening, or any guarantee of user authenticity or safety.
4.2 ASSUMPTION OF RISK FOR PHYSICAL MEETINGS
BY USING MATCHAMOCHA, YOU EXPRESSLY ACKNOWLEDGE AND ASSUME ALL RISKS ASSOCIATED WITH MEETING OTHER USERS IN PERSON, including but not limited to risks of:
• Physical harm, injury, assault, battery, or violence
• Sexual assault, harassment, or misconduct
• Emotional distress, psychological harm, or trauma
• Theft, fraud, financial loss, or property damage
• Stalking, harassment, or unwanted contact
• Exposure to communicable diseases or health conditions (including but not limited to COVID-19, STIs, or other infectious diseases)
• Abduction, kidnapping, or false imprisonment
• Any felonious, criminal, tortious, or otherwise unlawful conduct by other users
MATCHAMOCHA IS NOT RESPONSIBLE FOR AND EXPRESSLY DISCLAIMS ALL LIABILITY FOR ANY HARM, INJURY, DAMAGE, LOSS, OR CRIMINAL CONDUCT THAT OCCURS DURING OR AS A RESULT OF IN-PERSON MEETINGS ARRANGED THROUGH THE SERVICE.
4.3 NO GUARANTEE OF SAFETY
No dating platform can guarantee the safety of its users. While we may provide safety tips, reporting tools, and other features, these tools do not guarantee your safety and are not a substitute for exercising your own judgment and following appropriate safety precautions.
Safety features, if any, are provided on an "as is" basis without warranty of effectiveness.
4.4 OFF-PLATFORM CONDUCT
MatchaMocha is not responsible for the conduct of any user on or off the Service. This includes: • Actions taken during in-person dates, meetups, or encounters
• Communications or interactions occurring outside the MatchaMocha platform (text messages, phone calls, social media, email, etc.)
• Continued contact or harassment after a date has ended
• Any offline behavior or conduct by users you meet through the Service
• Interactions between users on third-party platforms or services
We reserve the right to investigate and take action (including account suspension or termination) based on users' offline conduct if we determine, in our sole discretion, that such conduct violates these Terms, poses a risk to other users, or is otherwise harmful to the MatchaMocha community.
4.5 VENUE AND LOCATION DISCLAIMER
MatchaMocha suggests meeting venues based on proximity and user preferences (using Google Places API) but makes no representations or warranties regarding: • The safety, security, or suitability of any venue
• The accessibility, hours of operation, or availability of any venue
• The quality, cleanliness, service, or condition of any venue
• The safety of surrounding areas, neighborhoods, or parking
• The accuracy of venue information (address, hours, photos)
You are responsible for: • Researching and evaluating the safety and appropriateness of any suggested venue
• Choosing to meet at a different location if you feel unsafe
• Verifying venue hours, accessibility, and suitability before the date
• Informing someone you trust of your meeting location, time, and plans
• Arranging your own safe transportation to and from the venue
MatchaMocha assumes no responsibility for any harm, injury, loss, or inconvenience occurring at, near, or in transit to/from any venue suggested by the Service.
4.6 TRANSPORTATION AND TRAVEL
MatchaMocha does not provide transportation services and is not responsible for: • Your transportation to or from meeting locations
• Any accidents, injuries, or losses occurring during travel
• Costs associated with transportation (parking fees, fuel, public transit fares, rideshare costs, etc.)
• Weather conditions, traffic, road conditions, or other travel-related issues
• Third-party transportation providers (Uber, Lyft, taxis, public transit, etc.)
You are solely responsible for arranging safe, reliable transportation and bearing all associated costs and risks.
4.7 MEDICAL AND HEALTH CONDITIONS
You are solely responsible for your own health and medical needs. MatchaMocha is not responsible for: • Any medical emergencies occurring before, during, or after dates
• Allergic reactions, food sensitivities, dietary restrictions, or medication interactions
• Pre-existing medical conditions, disabilities, or health issues
• Access to medical care, emergency services, or hospitals
• Transmission of communicable diseases or infections
If you have any medical conditions, allergies, disabilities, or health concerns that may affect your safety during in-person meetings, you are responsible for: • Disclosing relevant health information to your date (if you choose to)
• Taking appropriate precautions to protect your health
• Carrying necessary medications, medical devices, or emergency contact information
• Choosing venues that accommodate your health needs
MatchaMocha makes no guarantees about the health status, vaccination status, or medical conditions of any user.
4A. Safety Guidelines and Recommendations
While MatchaMocha is not responsible for your safety during in-person meetings (see Section 4), we strongly recommend following these safety guidelines:
Before the Date
✓ Meet in Public Places: Always meet in well-lit, populated public areas (never at someone's home or private location)
✓ Tell Someone: Inform a trusted friend or family member about: • Where you're going (venue name and address)
• When you're meeting
• Who you're meeting (show them the match profile)
• When you expect to return
✓ Share Your Location: Enable location sharing with a trusted contact during the date
✓ Research the Venue: Check reviews, hours, and safety of the neighborhood
✓ Arrange Your Own Transportation: Drive yourself or use a rideshare - don't accept rides from your date initially
✓ Limit Alcohol: Stay alert and in control - avoid excessive drinking
✓ Guard Personal Information: Don't share your home address, workplace address, or financial information
During the Date
✓ Trust Your Instincts: If something feels wrong, leave immediately
✓ Stay in Public: Don't go to secluded areas or second locations
✓ Keep Your Phone Charged: Ensure you can call for help or transportation
✓ Watch Your Drink: Never leave your drink unattended
✓ Set Boundaries: It's okay to end the date early if you're uncomfortable
After the Date
✓ Report Concerning Behavior: Use our in-app reporting tool if your date violated policies or made you feel unsafe
✓ Block and Report: If someone is harassing you, block them and report to us immediately
✓ Seek Help if Needed: Contact law enforcement if you experience or witness criminal activity
IMPORTANT: These are recommendations only. Following them does not guarantee your safety, and MatchaMocha is not liable for harm occurring despite following these guidelines.
If you are in immediate danger, call 911 or your local emergency services.
5. User Accounts and Responsibilities
5.1 Account Creation
To use MatchaMocha, you must create an account by providing: • Phone number (required for SMS verification via Twilio)
• Name (must be your real first name)
• Email address
• Date of birth (to verify age 18+)
• Gender (Male, Female, or Non-Binary)
• Ethnicity
• Profile photo(s)
• Bio (optional but recommended)
• Dating preferences (gender preference, age range, ethnicity preferences, date type preferences, location radius, time availability)
You agree to provide accurate, current, and complete information during registration and to update your information to keep it accurate, current, and complete.
Providing false information (including fake names, ages, photos, or other profile details) violates these Terms and may result in account termination.
5.2 Phone Verification
All users must verify their phone number via SMS before accessing the Service. We use Twilio, a third-party SMS service, to send verification codes.
By providing your phone number, you: • Consent to receive SMS messages from MatchaMocha via Twilio
• Understand that standard SMS rates may apply (charged by your mobile carrier)
• Represent that you own or have authorization to use the phone number provided
• Understand that your phone number will be used to prevent duplicate accounts and fraud
Your phone number is not shared with other users unless you choose to share it directly.
5.3 Account Security
You are responsible for: • Maintaining the confidentiality of your login credentials (password, verification codes, etc.)
• All activity occurring under your account
• Notifying us immediately at echocursor@gmail.com if you suspect unauthorized access to your account
Do not share your account credentials with anyone. You are liable for all actions taken using your account, whether authorized by you or not.
5.4 One Account Policy
Each user may maintain only ONE active account.
You may not: • Create multiple accounts for any reason
• Use another person's account
• Allow others to use your account
• Create a new account if your previous account was suspended or terminated
• Sell, trade, or transfer your account to another person
Violation of the one-account policy may result in termination of all associated accounts without refund.
5.5 Profile Photos and Content
All photos must: • Clearly show your face
• Be recent (within the last year) and accurately represent your current appearance
• Be of YOU (no group photos where you can't be identified, photos of other people, celebrities, AI-generated images, or stock photos)
• Not include nudity, sexually suggestive content, violence, hate symbols, or illegal activity
• Not include minors (children under 18)
• Not be heavily filtered or edited to mislead about your appearance
We reserve the right to remove photos that violate these standards and to request additional verification if we suspect photos are not authentic.
5.6 Inactive Accounts
Accounts that remain inactive for 12 consecutive months (no login, no matches, no activity) may be subject to: • Automatic deletion of profile data
• Suspension of account access
• Removal from the matching queue
• Deletion of credits and virtual items
We will notify you via email before deleting inactive accounts. You may prevent deletion by logging in and using the Service.
6. User Conduct and Prohibited Activities
6.1 Acceptable Use
You agree to use the Service in a lawful, respectful, and appropriate manner. You agree NOT to:
Harassment and Abuse: • Harass, threaten, stalk, intimidate, or harm any other user (online or offline)
• Send unwanted sexual content, messages, or advances
• Engage in hate speech, discrimination, or bullying based on protected characteristics
• Use abusive, obscene, or offensive language
Fraud and Deception: • Impersonate any person or entity
• Falsely state or misrepresent your identity, age, location, intentions, or affiliation
• Use photos that are not of you or that misrepresent your appearance
• Use AI, deepfake, or digitally altered content to mislead others
• Engage in catfishing or romance scams
Prohibited Uses: • Use the Service for any purpose other than finding in-person dates
• Solicit money, financial information, gifts, or donations from other users
• Promote or advertise products, services, businesses, websites, social media accounts, or other commercial ventures
• Recruit users for multi-level marketing, pyramid schemes, or other business opportunities
• Engage in prostitution, sex work, or sexual solicitation
Illegal Activity: • Use the Service to facilitate any illegal activity
• Share, distribute, or promote illegal drugs, weapons, or contraband
• Engage in fraud, identity theft, or financial crimes
• Violate any local, state, national, or international laws
Platform Abuse: • Submit false, malicious, or biased reports against other users
• Spam users with repetitive or unsolicited messages
• Share harmful links, viruses, malware, or phishing attempts
• Scrape, harvest, or collect user data through automated means
• Reverse engineer, decompile, or attempt to extract source code from the app
• Create multiple accounts or attempt to evade bans or suspensions
• Use VPNs, proxies, or other tools to circumvent geographic restrictions or bans
• Interfere with or disrupt the Service or servers
Profile Violations: • Post explicit, pornographic, or sexually suggestive content
• Display nudity, sexual acts, or graphic violence
• Include hate symbols, gang signs, or imagery promoting violence
• Promote illegal activity, drug use, weapons, or criminal conduct
6.2 No-Show and Cancellation Policy
If you match with another user and agree to a scheduled date, you are expected to attend or cancel with reasonable notice.
Repeated failure to attend scheduled dates ("no-shows") or last-minute cancellations may result in: • Temporary suspension from matching (24 hours to 7 days)
• Credit penalties or loss of privileges
• Permanent account termination
However, you always have the right to cancel or not attend a date if you feel unsafe, uncomfortable, or unwell. Your safety comes first. We encourage you to trust your instincts and prioritize your well-being.
If you need to cancel a date: • Cancel as soon as possible to give your match notice
• You may provide a reason, but it is not required
• Genuine safety concerns will not result in penalties
6.3 Reporting and Enforcement
If another user violates these Terms or engages in harmful conduct, you may report them using our in-app reporting tools.
How to Report: • Tap the flag icon on a user's profile or chat
• Select the violation type (harassment, inappropriate content, safety concern, etc.)
• Provide additional details (optional but helpful)
What Happens Next: • All reports are reviewed by our team
• Reports are confidential - the reported user will not know who reported them
• We may investigate by reviewing chat logs, profiles, and other evidence
• Automatic actions may be taken based on violation severity:
• 1st offense: Warning issued automatically
• 2nd offense: Permanent ban issued automatically
• Serious violations (violence, explicit content, illegal activity): Immediate permanent ban
False Reports: • Submitting false, malicious, or biased reports violates these Terms
• Users who repeatedly submit false reports may be warned or banned
• Do not report someone simply because you didn't enjoy the date - reporting is for policy violations only
MatchaMocha is not obligated to take action on any report and reserves the right to determine appropriate responses in our sole discretion.
We may suspend or terminate accounts based on violations occurring on or off the platform, including conduct during in-person dates.
7. Credits, Subscriptions, and Payments
7.1 Credit System
MatchaMocha operates on a credit-based system where credits are required to enter the matching queue and find dates.
Types of Credits:
Matcha Credits (🍵) - Limited, Renewable • Free users receive 1 Matcha credit per week
• Credits renew every Monday at 12:01 AM (your local timezone)
• If you have 0 Matcha credits on Monday, you receive 1 credit automatically
• If you already have Matcha credits, no additional credits are granted
• Matcha credits are consumed when you successfully match (not when you enter the queue)
Mocha Credits (☕) - Unlimited, Purchased • Mocha credits can be purchased through in-app purchases
• Mocha credits never expire
• Mocha credits are consumed preferentially over Matcha credits when matching
Credit Consumption: • 1 credit is consumed when you successfully match with another user
• Credits are not consumed if:
• You enter the queue but don't find a match
• You cancel your queue entry before matching
• Your match is cancelled before the date
7.2 Subscriptions and In-App Purchases
MatchaMocha may offer premium subscriptions, credit packages, or other in-app purchases.
Billing Terms: • All purchases are processed through third-party payment providers (Apple App Store, Google Play Store, Stripe, or other authorized processors)
• Prices are displayed in your local currency and include applicable taxes
• Payment is charged to your Apple ID, Google Play account, or payment method on file at the time of purchase
Subscriptions (if offered): • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage or cancel your subscription through your Apple ID or Google Play account settings
• Cancellation takes effect at the end of the current billing period
• No refunds for partial subscription periods
Third-Party Payment Processors: • Purchases made through Apple App Store are governed by Apple's Terms of Service and refund policies
• Purchases made through Google Play Store are governed by Google's Terms of Service and refund policies
• Purchases made via Stripe or other web payment processors are governed by their respective terms
You are responsible for any fees charged by your payment provider, bank, or mobile carrier.
7.3 Virtual Items and No Monetary Value
Credits, boosts, and other in-app purchases are VIRTUAL ITEMS with no monetary value.
Virtual items: • Are not redeemable for cash or credit
• Cannot be transferred to other users
• Cannot be exchanged, refunded, or sold
• Have no value outside of MatchaMocha
• Are forfeited upon account termination
MatchaMocha reserves the right to manage, regulate, control, modify, suspend, or eliminate virtual items at any time, for any reason, without liability to users.
7.4 Refund Policy
All purchases are final and non-refundable, except: • Where required by applicable law (e.g., EU consumer protection laws)
• In cases of unauthorized charges (you must report within 30 days)
• At MatchaMocha's sole discretion on a case-by-case basis
California Residents: You have a 3-day cancellation right for all paid services. See Section 7.8 and our California Addendum for details.
Credits are not refunded if: • Your account is terminated for violating these Terms
• You voluntarily delete your account
• You are dissatisfied with a match or date
• You choose not to attend a scheduled date
• Technical issues prevent you from using credits (we will restore credits in this case)
To request a refund: • Contact echocursor@gmail.com with your order details
• Refund requests must be submitted within 30 days of purchase
• Include your reason for requesting a refund
7.5 Cancellation Instructions
To cancel a subscription: • Apple users: Go to Settings > [Your Name] > Subscriptions > MatchaMocha > Cancel Subscription
• Android users: Go to Google Play Store > Menu > Subscriptions > MatchaMocha > Cancel Subscription
• Web users: Log in to your account > Settings > Subscription > Cancel
Cancellation takes effect at the end of the current billing period. You will retain access to subscription features until then.
7.6 Promotional Codes and Gift Cards
Promotional Codes: • MatchaMocha may offer promotional codes, discount codes, or referral credits from time to time
• Promo codes are subject to specific terms and expiration dates
• Promo codes may not be combined with other offers unless explicitly stated
• Promo codes have no cash value and cannot be sold or transferred
• We reserve the right to revoke promo codes obtained through fraudulent means
Gift Cards (if offered): • Gift cards can be redeemed for credits or subscription time
• Gift cards are non-refundable and cannot be exchanged for cash
• Lost or stolen gift cards will not be replaced
• Gift card balances do not expire
7.7 App Store and Third-Party Platform Terms
Apple App Store: • If you download MatchaMocha from the Apple App Store, you acknowledge that:
• These Terms are between you and MatchaMocha, not Apple
• Apple has no obligation to provide support for the app
• Apple is not responsible for addressing claims relating to the app
• Apple is a third-party beneficiary of these Terms and may enforce them
Google Play Store: • If you download MatchaMocha from Google Play, you acknowledge that:
• These Terms are between you and MatchaMocha, not Google
• Google is not responsible for the app or its content
• Google has no obligation to provide support
You must comply with all applicable third-party terms of service when using MatchaMocha.
7.8 California Residents - Additional Terms
If you are a California resident, additional terms and rights apply to your use of MatchaMocha.
Three-Day Cancellation Right: • California residents may cancel any paid service purchase until midnight of the third business day after purchase
• Cancellation may be made by email to echocursor@gmail.com
• Full refund will be issued within 10 business days
• See our California Addendum for complete details
Additional California Rights: • Right to cancel due to relocation (if service unavailable in new area)
• Right to relief from payment obligations in event of death or disability
• Right to prorated refunds for unused services
• Enhanced privacy rights under CCPA (California Consumer Privacy Act)

The California Addendum is incorporated into these Terms and is legally binding for California residents.
8. Privacy and Data Protection
8.1 Privacy Policy

By using MatchaMocha, you consent to our collection, use, and sharing of your personal data as described in the Privacy Policy.

MatchaMocha collects and processes the following types of data:
Account Information: • Name, age, gender, ethnicity
• Email address and phone number
• Profile photos and bio
• Dating preferences
Location Data: • GPS coordinates for proximity-based matching
• City, state, and zip code
• Search radius and location pin placement
• Venue suggestions based on your location
Usage Data: • Matches, dates, and queue entries
• Messages and chat history
• Reports submitted and received
• Credits purchased and consumed
• Time availability selections
Device Data: • Device ID, operating system, app version
• IP address
• Browser type and language
Third-Party Data: • Phone verification data from Twilio
• Venue data from Google Places API
• Payment data from payment processors (we do not store full credit card numbers)
8.3 How We Use Your Data
We use your data to: • Facilitate matching and coordinate in-person dates
• Suggest nearby venues and meeting times
• Process payments and manage credits
• Enforce these Terms and Community Guidelines
• Investigate reports and respond to safety concerns
• Improve the Service and develop new features
• Send important notifications (match alerts, date reminders, safety messages)
• Communicate with you about your account
8.4 Data Sharing
We may share your data with: • Other users: Profile information (name, age, photos, bio) is visible to your matches
• Third-party service providers: Twilio (SMS), Google (Maps/Places), payment processors, hosting providers, analytics tools
• Law enforcement: If required by law, subpoena, or to prevent imminent harm
• Business transfers: If MatchaMocha is acquired, merged, or sold
We do not sell your personal data to third parties for marketing purposes.
8.5 Data Retention
We retain your data for as long as your account is active, plus: • Profile data: Deleted 30 days after account deletion (unless needed for legal/safety reasons)
• Chat history: Deleted 90 days after account deletion
• Transaction records: Retained for 7 years (tax/accounting requirements)
• Reports and safety incidents: Retained indefinitely for safety purposes
• Banned user data: Phone numbers and device IDs retained for 3 years to prevent ban evasion

8.6 Data Protection Rights
Depending on your location, you may have rights under data protection laws (GDPR, CCPA, etc.):
GDPR Rights (EU/EEA Users): • Right to access your data
• Right to correct inaccurate data
• Right to delete your data ("right to be forgotten")
• Right to restrict processing
• Right to data portability

10. Intellectual Property
10.1 Platform Ownership
MatchaMocha and all associated intellectual property rights are owned by MatchaMocha or its licensors, including: • The MatchaMocha app, website, and software
• Logos, trademarks, service marks, and trade names ("MatchaMocha," "Matcha Credits," "Mocha Credits," coffee cup emoji designs, etc.)
• Matching algorithms and proprietary technology
• Design, layout, graphics, and user interface
• Content created by MatchaMocha (help articles, safety tips, etc.)
All rights reserved.
10.2 Prohibited Uses
You may not: • Copy, modify, distribute, sell, or lease any part of the Service
• Reverse engineer, decompile, disassemble, or attempt to derive source code
• Create derivative works based on the Service
• Use our trademarks, logos, or branding without prior written permission
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Use automated scripts, bots, or crawlers to access the Service
• Frame or mirror any part of the Service on another website
10.3 User Content Ownership
You retain ownership of content you create and post to MatchaMocha (profile photos, bio, messages, etc.).
However, by posting content to the Service, you grant MatchaMocha a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to: • Use, reproduce, modify, adapt, publish, and display your content
• Distribute your content within the Service
• Create derivative works based on your content
• Sublicense your content to third parties for purposes of operating and promoting the Service
• Use your photos and likeness in marketing materials, advertisements, success stories, and promotional content (both online and offline)
This license continues even after you delete your account, to the extent your content has been: • Shared with other users (e.g., chat messages sent to matches)
• Incorporated into the Service (e.g., testimonials, marketing materials)
• Cached or stored in backups
If you do not want your photos used in MatchaMocha's marketing, you may opt out by emailing echocursor@gmail.com.
By posting content, you waive any moral rights or rights of attribution you may have in the content.
10.4 User Content Responsibility
You are solely responsible for all content you post, send, or share through the Service.
You represent and warrant that: • You own or have the right to use all content you post

• Your content does not violate any laws or regulations
• Your content complies with these Terms and Community Guidelines
You agree to indemnify, defend, and hold MatchaMocha harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from or related to your content or your use of the Service.
10.5 Reporting Copyright Infringement (DMCA)
If you believe content on MatchaMocha infringes your copyright, you may submit a DMCA takedown notice to:

• Warranties that the Service will be uninterrupted, secure, error-free, or free of viruses or harmful components
• Warranties regarding the accuracy, reliability, completeness, or timeliness of any information, content, or matches
• Warranties regarding the compatibility, suitability, quality, or success of any match or date
• Warranties regarding the safety, legitimacy, or conduct of any user
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
11.2 EXCLUSION OF DAMAGES
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MATCHAMOCHA AND ITS PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:
Direct, Indirect, Incidental, Special, Consequential, Exemplary, or Punitive Damages, including but not limited to: • Damages for lost profits, lost revenues, lost savings, lost business opportunity, loss of data, loss of goodwill, service interruption, computer damage, system failure, or any other commercial damages or losses
• Personal injury, emotional distress, physical harm, assault, sexual misconduct, theft, property damage, or any other harm resulting from:
• Your interactions with other users (online or offline)
• In-person meetings, dates, or encounters arranged through the Service
• The conduct, actions, or criminal behavior of any other user
• Your decision to meet, communicate with, or trust any other user
• Venues suggested by the Service
• Travel to or from meeting locations
• Medical emergencies or health conditions
• Any damages arising from:
• Your use or inability to use the Service
• Unauthorized access to your account or content
• Errors, bugs, viruses, malware, or technical failures
• Deletion, corruption, or loss of data
• Content posted by other users
• Third-party services or integrations
• The suspension or termination of your account
• Changes to the Service, pricing, or features
• Discontinuation of the Service
THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED (contract, tort, negligence, strict liability, or otherwise), AND EVEN IF MATCHAMOCHA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL MATCHAMOCHA BE LIABLE FOR ANY HARM RESULTING FROM: • Downloading or accessing content through the Service
• Any user conduct or content
• Any third-party conduct or content
• Force majeure events (see Section 17.6)
11.3 AGGREGATE LIABILITY CAP
In no event shall MatchaMocha's aggregate liability to you for all claims arising from or related to the Service exceed the greater of: • (a) The amount you paid to MatchaMocha, if any, during the twenty-four (24) month period immediately preceding the event giving rise to liability, OR
• (b) One hundred dollars ($100 USD)
If you have not paid any fees to MatchaMocha (i.e., you are a free user), MatchaMocha's aggregate liability shall not exceed $100 USD.
This liability cap applies to all claims collectively, not to each claim individually.
11.4 Jurisdictional Limitations
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions: • The above limitations and exclusions shall apply to the greatest extent permitted by law
• Our liability shall be limited to the maximum extent permitted by applicable law
• If any limitation is found to be unenforceable, the remaining limitations shall continue to apply
11.5 Basis of the Bargain
You acknowledge that the limitations of liability in this Section 11 are fundamental elements of the basis of the bargain between you and MatchaMocha, and that MatchaMocha would not provide the Service without these limitations.
12. Indemnification
You agree to indemnify, defend, and hold harmless MatchaMocha, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, partners, licensors, and service providers (collectively, "MatchaMocha Parties") from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorney fees and court costs) arising from or related to:
• Your use or misuse of the Service
• Your violation of these Terms, the Privacy Policy, or Community Guidelines
• Your violation of any rights of another person or entity, including intellectual property rights, privacy rights, or publicity rights
• Your content (photos, bio, messages, reports, etc.)
• Your conduct or interactions with other users, whether online or offline, including:
• Your behavior during in-person dates or meetings
• Harm, injury, or loss caused to other users by your actions
• Harassment, threats, or abusive conduct toward other users
• Any false, misleading, or malicious reports you submit
• Your attendance or non-attendance at scheduled dates
• Information you provide during registration or in your profile
• Your breach of any representation or warranty in these Terms
• Claims by third parties that your content or conduct violates their rights or applicable laws
This indemnification obligation includes: • Defending MatchaMocha Parties in any legal proceedings
• Paying all damages, settlements, judgments, costs, and attorney fees
• Cooperating fully in the defense of any claims
This indemnification obligation survives termination of your account and these Terms.
MatchaMocha reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you. In such cases, you agree to cooperate with MatchaMocha's defense of such claims.
13. Dispute Resolution and Arbitration
13.1 Informal Resolution
Before filing a legal claim, you agree to first attempt to resolve the dispute informally by contacting us at:

13.2 Binding Arbitration
If informal resolution fails, you agree that any dispute, claim, or controversy arising from or relating to these Terms, the Privacy Policy, your use of the Service, or your relationship with MatchaMocha (collectively, "Disputes") shall be resolved through binding individual arbitration, except as provided in Section 13.3.
By agreeing to arbitration, you waive your right to: • Have Disputes heard by a judge or jury in court
• Participate in a class action, class arbitration, or representative action
• Pursue claims on a class-wide or collective basis
Arbitration Details: • Governing Law: The Federal Arbitration Act (FAA) governs the interpretation and enforcement of this arbitration provision
• Arbitration Rules: Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules
• Arbitrator Selection: A single neutral arbitrator will be selected in accordance with AAA rules
• Location: Arbitration will be conducted in Georgia or remotely via video conference
• Language: Arbitration will be conducted in English
• Fees: Each party shall bear its own costs and attorney fees, unless the arbitrator awards costs or fees to the prevailing party as permitted by law
• Governing Law: Disputes will be governed by the laws of the State of Georgia, without regard to conflict of law principles
Arbitration Award: • The arbitrator may award the same damages and relief that a court could award
• The arbitrator's decision is final and binding, except for limited appeals available under the FAA
• Judgment on the arbitration award may be entered in any court having jurisdiction
13.3 Exceptions to Arbitration
The following Disputes are not subject to arbitration and may be brought in court: • Intellectual Property Claims: Disputes relating to the validity, infringement, or misappropriation of intellectual property rights (trademarks, copyrights, patents, trade secrets)
• Injunctive or Equitable Relief: Claims for injunctive relief or other equitable remedies to prevent immediate and irreparable harm
• Small Claims Court: Claims that qualify for small claims court (if the claim meets jurisdictional requirements and remains in small claims court)
For these exceptions, you consent to the exclusive jurisdiction of courts located in Georgia.
13.4 Class Action Waiver
YOU AND MATCHAMOCHA AGREE THAT DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY, AND NOT AS A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION.
• Neither you nor MatchaMocha may bring a claim as a plaintiff or class member in a class, consolidated, or representative action
• The arbitrator may not consolidate more than one person's claims or preside over any form of class or representative proceeding
• If this class action waiver is found to be invalid or unenforceable, the entire arbitration agreement shall be void, and the Dispute shall be resolved in court
BY AGREEING TO THESE TERMS, YOU ARE GIVING UP YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT.
13.5 30-Day Opt-Out Right
You have the right to opt out of this arbitration agreement within 30 days of creating your account or accepting these Terms (whichever is earlier).
To opt out, you must send written notice to:

If you opt out: • This arbitration agreement will not apply to you
• Disputes will be resolved in court (see Section 13.6)
• All other Terms remain in effect
If you do not opt out within 30 days, you will be bound by the arbitration agreement.
13.6 Judicial Forum for Disputes (if Arbitration Doesn't Apply)
If arbitration does not apply (either because you opted out, the Dispute is excepted under Section 13.3, or the arbitration agreement is found invalid), you agree that:
• Disputes shall be resolved exclusively in state or federal courts located in Georgia
• You consent to the personal jurisdiction of such courts
• You waive any objection to venue in such courts
• You waive any right to a jury trial
14. Technology and Algorithm Disclosure
14.1 Automatic Matching Algorithm
MatchaMocha uses a proprietary automatic matching algorithm to pair users for in-person dates.
How Matching Works: • Users enter a matching queue and are paired based on compatibility
• The algorithm uses First-In-First-Out (FIFO) logic: the longest-waiting compatible user is matched first
• Compatibility is determined by filtering users based on:
• Mutual gender preferences (both users match each other's gender preference)
• Mutual age range (both users fall within each other's acceptable age range)
• Mutual ethnicity preferences (both users accept each other's ethnicity)
• Overlapping date type preferences (at least one shared date type: coffee, restaurant, walk/park, movie, bar)
• Overlapping time availability (at least one hour where both users are available today)
• Location proximity (users' search radius circles overlap based on GPS coordinates)
• You do not manually select your matches - the algorithm automatically pairs you with the first compatible user in the queue
What We Don't Guarantee: • We do not guarantee that you will be matched with anyone
• We do not guarantee compatibility, chemistry, or romantic interest
• We do not guarantee that matches will attend the date
• We do not guarantee that the algorithm is perfect or error-free
The matching algorithm is subject to change at any time without notice.
14.2 Location Data and Proximity Matching
MatchaMocha requires access to your device's GPS location to facilitate proximity-based matching and venue suggestions.
How We Use Location Data: • Real-time location: Used when you drop a pin on the map to set your search location
• Search radius: You select a radius (e.g., 5km, 10km, 20km) around your pinned location
• Proximity matching: The algorithm checks if your search circle overlaps with potential matches' search circles
• Venue suggestions: We use Google Places API to suggest nearby venues based on your location and date type preferences
• Distance calculations: We calculate distance between users using the Haversine formula (great-circle distance)
Location Permissions: • You must grant location permissions to use MatchaMocha
• Location data is only accessed when you use the app (not continuously in the background)
• You can update your search location at any time
Location Privacy: • Your exact GPS coordinates are not shared with other users
• Matches can see approximate distance (e.g., "3.2 km away") but not your precise location
• Venue suggestions are visible to matches after you are paired
We do not: • Track your location continuously
• Share your location history with third parties (except as required by law)
• Use location data for advertising purposes
14.3 Venue Selection System
MatchaMocha automatically suggests meeting venues based on your and your match's shared preferences.
How Venue Suggestions Work: • After matching, the app selects a date type that both users selected in their preferences (e.g., "coffee" if both checked it)
• The app searches for nearby venues using Google Places API based on the date type:
• Coffee → Cafes, coffee shops
• Restaurant → Restaurants, dining establishments
• Walk/Park → Parks, trails, outdoor spaces
• Movie → Movie theaters, cinemas
• Bar → Bars, pubs, lounges
• The app suggests 3 nearby venues equidistant from both users (within overlapping search radius)
• Venues are selected based on proximity, ratings, and availability (as provided by Google)
Venue Information Accuracy: • Venue data (name, address, hours, photos, ratings) is provided by Google Places API
• We do not guarantee the accuracy of venue information
• Venues may be closed, relocated, or unavailable despite appearing in suggestions
• You are responsible for verifying venue details before attending
We are not responsible for: • Venue closures, changes in hours, or relocation
• Quality, safety, or suitability of suggested venues
• Accessibility or amenities at venues
• Costs, parking, or entry fees at venues
14.4 AI and Automated Decision-Making
MatchaMocha uses automated decision-making and algorithms to operate the Service.
Automated Processes: • Matching: Algorithm automatically pairs users without human review
• Venue Selection: Algorithm automatically selects venue suggestions without human review
• Meet Time Calculation: Algorithm calculates meeting times based on overlapping availability
• Content Moderation: Automated tools scan profiles and messages for prohibited content (nudity, hate speech, spam, etc.)
• Report Processing: Automated systems may issue warnings or bans based on reports received
Human Review: • Some content moderation decisions are reviewed by humans
• Report escalations may be reviewed by our safety team
• Ban appeals may be reviewed manually
Your Rights: • You have the right to object to automated decision-making that produces legal effects or significantly affects you

14.6 Beta Features and Experimental Services
MatchaMocha may offer beta features, experimental services, or early access programs from time to time.
By using beta features, you acknowledge that: • Beta features are provided "as is" and may contain bugs or errors
• Beta features may be unstable, incomplete, or change without notice
• Beta features may be discontinued at any time
• Beta features may not be available to all users
• We are not liable for any issues arising from beta features
Feedback: If you provide feedback on beta features, you grant us a royalty-free, perpetual license to use that feedback to improve the Service.
15. Term and Termination
15.1 Term
These Terms remain in effect for as long as you use the Service.
15.2 Termination by You
You may terminate your account at any time by: • Going to Settings > Account > Delete Account in the app
• Emailing echocursor@gmail.com with a deletion request
Upon deletion: • Your account is immediately deactivated
• Your profile is removed from public view
• Your data is deleted according to our data retention policy (see Section 8.5)
• Credits, purchases, and subscriptions are non-refundable
• Active subscriptions will not be cancelled automatically - you must cancel through your Apple ID or Google Play account
15.3 Termination by MatchaMocha
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:
Violations of Terms: • Violation of these Terms of Service, Privacy Policy, or Community Guidelines
• Harassment, threats, hate speech, or abusive conduct
• Fraudulent activity, scamming, or catfishing
• Illegal activity or criminal conduct
• Providing false information or fake profiles
• Creating multiple accounts
• Submitting false or malicious reports
Safety Concerns: • Reports from other users about your conduct
• Offline conduct involving other users (harassment, assault, threats, etc.)
• Behavior that poses a risk to other users or the MatchaMocha community
• Suspected criminal activity
Other Reasons: • Inactivity (no login for 12+ months)
• Violation of third-party terms (payment processor policies, etc.)
• Maintenance, security, or legal reasons
• At our sole discretion for any reason or no reason
Upon termination by MatchaMocha: • You lose all access to your account immediately
• You lose all credits, purchases, and subscription benefits (non-refundable)
• You may not create a new account without our permission
• We may retain certain data as described in Section 8.5
15.4 Effect of Termination
Upon termination (by you or us): • Your right to use the Service immediately ceases
• MatchaMocha may delete your account and content (subject to data retention requirements)
• Pending matches or dates are cancelled
• Subscriptions are not automatically refunded - you must request refunds from Apple/Google

15.5 Inactive Accounts
Accounts that remain inactive for 12 consecutive months may be subject to automatic deletion.
Before Deletion: • We will send email notifications at 9 months, 11 months, and 11.5 months of inactivity
• You can prevent deletion by logging in and using the Service
• Deletion includes profile data, messages, and credits (non-refundable)
What is considered activity: • Logging into your account
• Entering the matching queue
• Messaging a match
• Updating your profile
16. Modifications to Terms
16.1 Right to Modify
MatchaMocha reserves the right to modify, update, or replace these Terms at any time, for any reason, including to: • Reflect changes to the Service or new features
• Comply with legal or regulatory requirements
• Improve clarity or address ambiguities
• Respond to user feedback or safety concerns
16.2 Notice of Changes
We will notify you of material changes to these Terms by: • Posting the updated Terms in the app with a new "Last Updated" date
• Sending an email notification to the email address associated with your account (if you have provided one)
• Displaying an in-app notification or pop-up when you next open the app
• Posting a notice on our website (if applicable)
For minor, non-material changes (e.g., typo corrections, clarifications), we may update the Terms without notice.
16.3 Acceptance of Changes
Continued use of the Service after changes become effective constitutes your acceptance of the modified Terms.
• Changes take effect on the date indicated in the "Last Updated" field
• If you do not agree to the changes, you must stop using the Service and delete your account
• Deleting your account is your sole remedy if you disagree with updated Terms
We recommend reviewing the Terms periodically to stay informed of any changes.
16.4 Material Changes Requiring Consent
For material changes that significantly affect your rights (e.g., changes to arbitration, liability, or pricing), we may require you to affirmatively accept the new Terms before continuing to use the Service.
If you do not accept the new Terms, your account may be suspended or terminated, and you will lose access to the Service.
17. General Provisions
17.1 Entire Agreement
These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and MatchaMocha regarding your use of the Service and supersede all prior agreements, understandings, representations, or communications (whether written or oral).
17.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.
The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
17.3 Waiver
Our failure to enforce any provision of these Terms, or to exercise any right or remedy, shall not constitute a waiver of that provision, right, or remedy.
No waiver by MatchaMocha of any breach or default shall be deemed a waiver of any subsequent breach or default.
Any waiver must be in writing and signed by an authorized representative of MatchaMocha.
17.4 Assignment
You may not assign, transfer, or delegate these Terms or your account to any other person or entity without our prior written consent.
MatchaMocha may assign or transfer these Terms and all associated rights and obligations to any third party at any time without notice, including in connection with a merger, acquisition, sale of assets, or corporate reorganization.
These Terms bind and benefit both parties and their respective successors and permitted assigns.
17.5 Governing Law
These Terms and any disputes arising from or relating to the Service shall be governed by and construed in accordance with the laws of the State of Georgia, United States of America, without regard to its conflict of law principles.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
17.6 Force Majeure
MatchaMocha shall not be liable for any delay or failure to perform due to circumstances beyond our reasonable control, including but not limited to: • Acts of God (earthquakes, floods, hurricanes, pandemics, etc.)
• Natural disasters
• War, terrorism, riots, or civil unrest
• Government actions, laws, or regulations
• Strikes or labor disputes
• Internet, telecommunications, or utility failures
• Third-party service provider outages (Twilio, Google, AWS, payment processors, etc.)
• Cyberattacks, hacking, or data breaches
• Any other event beyond our reasonable control
During a force majeure event, our obligations under these Terms are suspended for the duration of the event. We will make reasonable efforts to resume normal operations as soon as possible.
17.7 No Third-Party Beneficiaries
These Terms are for the sole benefit of you and MatchaMocha. No third party (including other users, venues, or service providers) has any right to enforce or rely on these Terms.
17.8 Headings
Section headings in these Terms are for convenience only and do not affect the interpretation of any provision.
17.9 Language
These Terms are written in English. Any translations provided are for convenience only. In the event of any conflict between the English version and a translation, the English version shall prevail.
17.10 Electronic Communications
By using the Service, you consent to receive electronic communications from MatchaMocha, including: • Emails about your account, matches, and dates
• SMS messages for phone verification and date reminders
• Push notifications about matches, messages, and safety alerts
• In-app messages and announcements
You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
You may opt out of marketing communications but cannot opt out of transactional or safety-related communications while using the Service.

18. ACKNOWLEDGMENT AND AGREEMENT
BY CREATING AN ACCOUNT OR USING MATCHAMOCHA, YOU ACKNOWLEDGE THAT:
✓ You have read, understood, and agree to be bound by these Terms of Service, the Privacy Policy, and the Community Guidelines
✓ You understand that MatchaMocha facilitates in-person meetings between users through automatic matching
✓ You assume all risks associated with meeting other users in person, including risks of physical harm, assault, theft, stalking, health risks, and criminal conduct
✓ MatchaMocha does not conduct background checks on users and makes no representations about users' identity, character, health, criminal history, or intentions
✓ MatchaMocha is not responsible for the conduct, identity, health, or safety of any user, whether online or offline
✓ MatchaMocha is not liable for any harm, injury, damage, loss, or criminal conduct occurring during or as a result of in-person meetings arranged through the Service
✓ You are solely responsible for your own safety, interactions with other users, and decisions about attending dates
✓ You agree to indemnify and hold MatchaMocha harmless from claims arising from your use of the Service, your conduct, or your content
✓ You agree to resolve disputes through binding individual arbitration (unless you opt out within 30 days) and waive your right to a jury trial and class actions
✓ You waive your right to a jury trial and agree to resolve disputes in arbitration or in courts located in Georgia
✓ Credits and purchases are non-refundable except as required by law
✓ The Service is provided "as is" without warranties of any kind
✓ MatchaMocha may modify these Terms at any time, and continued use constitutes acceptance
✓ MatchaMocha may terminate your account at any time for any reason or no reason

THESE TERMS CONTAIN IMPORTANT LEGAL PROVISIONS THAT SIGNIFICANTLY AFFECT YOUR RIGHTS, INCLUDING:
• Assumption of risk for in-person meetings (Section 4)

• "Queue": The matching queue where users wait to be paired with compatible users
• "Service": The MatchaMocha platform, including website, mobile application, and all related services

• "User": Any person who creates an account or uses MatchaMocha
